Once Strike 3 identifies the offender, it will sue them under the Digital Millennium Copyright Act. Under the Act, Strike 3 can demand up to $30,000 per illegal download for non-willful infringement, and up to $150,000 for intentional infringement.
If you ignore Strike 3, you may have to pay tens of thousands of dollars in damages when Strike 3 obtains a default judgment against you. A default judgment is when an entity or person filing a lawsuit wins by default because the defendant failed to respond. Your name will also be tied to allegations of illegally downloading pornographic adult films in public court documents.
Prior to Strike, Eisenstein had primarily worked in experimental theatre, as a designer and director with the Proletcult Theatre. Boris Mikhin [ru], head of the First Goskino factory, wanted to recruit Eisenstein to work in cinema, but Proletcult wanted to keep him. They negotiated and decided on a joint collaboration, a film cycle called "Towards Dictatorship of the Proletariat". The cycle was to be a historical panorama focused on lessons learned by the Russian working class during the pre-revolutionary period, through political activities such as strikes and underground publications. It had seven parts: Geneva-Russia, Underground, May Day, 1905, Strike, Prison Riots and Escapes, and October.

Whether or not you did download their content, you are still going to be sued. This is because at this point, Strike 3 Holdings believes you did, and the court believes they have enough evidence for the case to proceed.
I received a notice from my ISP informing me that Strike 3 Holdings, LLC had served a subpoena requesting my name and address from them. They recommended obtaining counsel to resolve the matter. I was extremely stressed about my situation, literally sick. I researched Strike 3 Holdings, LLC and everything I read made me feel even worse. I had no idea the consequences for downloading copy right files could be so steep. I had heard of warning letters issued to people I know, but never something like a subpoena.
The purpose of this article is merely to provide some free help on the Strike 3 Holdings movie lawsuits so that you can get straight to the answers instead of sorting through hundreds of articles on this website. The answers will be short and to the point.
If you have come to this web page, Strike 3 Holdings LLC is probably the company suing you. They are suing subscribers across the US for the unlawful download and seeding of their adult film titles produced under their adult film brands.
For example, exclusive rights include the right to make copies (infringed by downloading), the right to distribute copies (infringed by sharing/uploading/seeding), the right to display (infringed by streaming).
Here, copyright infringement allegedly happens when you connect to a swarm and download or upload one or more of their videos. Multiple software names (e.g., uT, Transmission) provides streaming services which activate when an internet user clicks on a link (e.g. from The [BLANK] Bay) which allow the internet user to download or stream the adult branded video.
Unrelated to The [BLANK] Bay (but relevant to the actual evidence claimed against the accused account holders in this case), there is reason to believe that Strike 3 is not actually tracking the entire download, but merely a snippet of it, so their evidence may be lacking.
Thus, many lawsuits have a legal defense, specifically that the accused downloader was not home (e.g., was at his trade job) when the downloader joined the online swarm using his internet account without his knowledge or consent.
It is the belief of the author that each Strike 3 Holdings LLC subpoena sent to accused downloaders is unethical in itself. The lawsuits that they file are likely not done so in order to protect the rights of the copyright holder, nor does that attorney have an intent to bring the case to trial.
This would be fair if the accused downloader were asked for the actual damages they caused (e.g., the loss of an annual subscription to the adult-branded websites, perhaps plus the costs of recovering the lost sale, e.g., the $400 filing fee for the lawsuit plus the attorney fees involved in recouping the losses), but this is not what they ask for.
Further, with the copyright laws and DMCA statutes as they are, there is no mechanism or method to force a copyright holder to consider the circumstances of a defendant, where even if that defendant did the downloading, the copyright holder would agree to release that defendant from liability just because they cannot afford to mount a minimal defense.
In this room, you will download whatever you can of the movie from everyone else (each participant shares pieces of the movie that they have acquired), and you will share whatever parts of the movie that you have already downloaded with everyone else in the room who has not yet acquired that piece of the movie.
If the actual downloader is not the account holder, the plaintiff attorneys learn who actually did the download, and they name and serve that new individual to be a defendant in the lawsuit in lieu of the account holder.
Strike 3 Holdings settlement agreements used to be very specific as to which specific Strike 3 Holdings titles were being settled, and the settlement used to cover ONLY THOSE TITLES and no other titles allegedly downloaded. This was back when the Patrick Collins, Inc. v. John Does 1-1000 cases were still being filed.
I thought I would share that Charter, aka Spectrum, emailed me a Notice of Copyright Infringement. They allege that I used BitTorrent to download FlashDance of all things - a movie from the early 80s. The ISP spy used by Paramount Pictures is IP-Echelon. BitTorrent lawsuits by the movie industry seem infrequent these days, but the email spooked me (my first notice ever). Anyone else receive this notice from Spectrum, and should I be concerned?

Mike Reynolds pets his cat outside his home in 1992, the year his 18-year-old daughter, Kimber, was shot and killed by a repeat offender. Two years later, his ballot initiative for California's three strikes law passed overwhelmingly. He has fought tirelessly to uphold it ever since. Fifteen years ago, California voters passed the strictest three strikes sentencing law in the nation. It doubled the penalty for a second felony if the first one was serious or violent. The so-called third strike carries a mandatory prison sentence of 25 years to life.
But instead of getting a drug program, Shane was charged with two counts of residential burglary. He did some time in prison. And years later, when he got picked up on that drug charge, the burglary convictions counted as his first two strikes.
In the 15 years since three strikes was passed, crime has declined significantly in California, as it has across the nation. Reynolds credits the law for that. Independent studies, however, have generally found that three strikes has not been a major factor.
According to David Kehr's review (which is posted on Letterboxd if you want to find it), he referred to this movie sort of literally as "homework" since, once it got wrested by the clutches of (sigh, fine, "alleged") rapist Harvey Weinstein and Miramax - and why they even greenlit this in the first place is sort of a mystery to me , producer Deutchman (a film professor at Columbia) posted notices all over the place for people to go see it... Well, anyway, if this is homework I wish I could do more of it!This is a fun and peppy and completely up-with-women AND perhaps more importantly outside of Hillary Clinton (for what it's worth) is the most up-with-women-as-political-heroes comedy that isnt funny LOL like as it is amusing and consistently clever. I could see someone not liking it on the whole because of how broad and big some of the gags go for, but what this filmmaker was going for - having this teen sex comedy (here PG13 I believe) set in that same just-before-fall63-spring64 period when everything changed and can thus join the company of little films like National Lampoon's Animal House and American Graffiti but for girls - was a more than valid idea, and the movie has a lot to say about systemic patriarchal structures as far as economy and social placement in life go. Not to mention all of the major performances from Dunst, Redgrave, Matarazzo and especially Hoffmann who is really the protagonist amid the ensemble, are all having a great time.... Oh, and try as he might, Vincent Karthiezer is still only giving his second most obvious character/performance here (this before of course Connor on Angel cemented #1 for him). If nothing else, it may be the ultimate sign of success that Weinstein's name is not Executive Producer on the film.
